All Owners planning on selling their houses are reminded that it is their responsibility to notify the purchaser that the property is bound by a covenant. Additionally, the seller is responsible for notifying the Association of the sale. The Association can (and does) obtain the sale information from a periodic search of the State's property records. The seller assumes all liability for properly informing the purchaser that the property is bound by a covenant, prior to the sale, and for providing the purchaser with a copy of the documentation.
For protection from liability, the seller is advised to obtain an official set of documentation (a.k.a. "resale package") from the property manager. There will be a fee charged.
