Parking

All parking spaces are available to all homeowners and their guests. There are no reserved spaces. Because, over the years, there have been numerous complaints about the lack of adequate parking, the Board, with the approval of the Association, in 1992 adopted the current parking rule. The Board has from time to time considered the feasibility of using parking tags that can be hung from the windows inside a car, but has not implemented the usage of parking tags.

The following is an excerpt from the Declaration:

Article VI, Use Restrictions and Easements, Section 8. "All vehicles belonging to an Owner or to members of an Owner's family or to a guest, tenant, or employees of an Owner, shall be parked in the spaces provided, and no such vehicle shall be parking in such a manner as to impede or prevent ready access to any other parking space."

The Board interprets the above to mean that all vehicles parked must be parked between tick marks. Additionally, no vehicle may be parked so as to impede an Owner's ability to enter or leave the Owner's driveway.

Additionally, from the BTCARC Declaration (Exhibit D of the Declaration), which is also binding on owners, the following states:

Article II, Section 2.07, Prohibited Uses and Nuisances. (d) "Except as herein provided, no junk vehicle, commercial vehicle, trailer, truck, camper, camp truck, house trailer, boat or other machinery or equipment of any kind or character (except for such equipment and machinery as may be reasonable, customary and usual in connection with the use and maintenance and operation of the Common Areas and Community facilities) shall be kept upon the Residential Lots nor (except for bona fide emergencies as distinguished from ordinary maintenance and repairs) shall the repair or extraordinary maintenance of automobiles or other vehicles be carried out thereon."

The Board interprets the above to mean that the only thing that may be parked in the Common Area parking lots are residential vehicles, except, for commercial vehicles on temporary business, such as in the repair or improvement of a residence, or for delivery.

The Board refers any complaints about inoperable or improperly parked vehicles to the City's Code Enforcement Division.
